Ahmed M. Elmokadem

Managing Partner

Mr. Elmokadem is Managing Partner of Esquire ILA and Chairman of our International Dispute Resolution Group. He is resident at Esquire ILA's California and Cairo offices.

With particular expertise in public international law, investor-state arbitration, and commercial disputes, Mr. Elmokadem's dispute resolution experience includes representation of private clients as well as governmental entities in arbitration and litigation before the world's leading institutions including: the World Bank's International Centre for the Settlement of Investment Disputes (ICSID); the International Chamber of Commerce (ICC); the London Court of International Arbitration (LCIA); the International Centre for Dispute Resolution of the American Arbitration Association (ICDR/AAA); the Cairo Regional Centre for the International Court of Arbitration (CRCICA); and United States Federal Courts in California and New York. As well, Mr. Elmokadem represents clients in disputes arbitration before specialized trade bodies including the Grain and Feed Trade Association (GAFTA); the London Maritime Arbitration Association (LMAA); and the Federation of Oils, Seeds, and Fats Associations(FOSFA).

Mr. Elmokadem's current engagements cover disputes valued in excess of US$5.5 billion in the agregate. He has been retained in matters involving North America, the Middle East, Latin America, Europe, an Asia. He is equally adept to structuring and negotiating complex cross-border commecial transactions, particularly with respect to broadcasting, finance, franchising, manufacturing, technology, licensing, and venture capital.

Prior to his affiliation with Esquire ILA, Mr. Elmokadem practiced law for several years in Washingto, D.C. at the International Dispute Resolution departments of some of the world's most prestigious law firms. He holds a Master of Laws (LLM) from Georgetown Universty Law Center, a Juris Doctorate (JD) from Santa Clara University School of Law, and a Bachelor of Arts (BA) in international relations from the University of San Diego.

He is admitted to practice law in the State of California, and pro hac vice before the U.S. Federal District Court for the Southern District of New York. He is a native English and Arabic speaker, and reads French and Spanish with basic business proficiency.

* Representing American and Bahaman investors, as plaintiffs' lead counsel, in a multibillion dollar litigtion before United States Federal Courts against the Arab Republic of Egypt and the National Bank of Egypt in connection with various public international law and United States Federal law violations committed by the defendants against the clients' investments in Egypt.

* Representing an American investor, as claimant's lead counsel, at ICSID annulment proceedings against the Arab Republic of Egypt in connection with Egypt's expropriation and destruction of the client's investment in a 182 acre beach front resort in Ain Sokhna, Egypt.

* Representing a BVI investor, as claimant's lead counsel, in arbitral proceedings before the ICC in London, governed by Cypriot law, against a Canadian corporation in connection with various breaches of a joint venture agreement for the exclusive licensing and operation of patented oil field technologies and services in the Middle East and Africa.

* Representing a major Egyptian entrepreneur, as defendnant's lead counsel, in litigation before United States Federal Courts governed by Kansas law in connection with the termination of a franchise agreement to exclusively operate a major chain of furniture outlets in Southern California.

* Representing one of Egypt's largest edible oil producers as claimant's lead counsel in institutional arbitral proceedings before FOSFA in London governed by UK law against its Belgian oilseeds supplier for breach of a supply agreement.

* Lead counsel to an American television content syndicator in negotiating international broadcast license agreements for the transmission of foreign based television content in North America via direct broadcast satellite.

* Lead counsel to to a leading Egyptian manufacturing, real estate, and media conglomorate in a broad range of international and domestic commercial transactions.
