Investor-State Disputes is a subset of public international law which addresses the relationship between foreign investors and the sovereign states hosting their investment. Disputes of this sort may arise in the context of expropriation of the foreign investment, unfair or inequitable treatment of the investor, undue influence upon the investor, inadequate due process of law, or arbitrary regulations, to name a few.

Pursuit of such claims requires highly specialized expertise in public international law, the international law of state responsibility, treaty law, and comparative procedural law. Most often, Investor-State Disputes are submitted to arbitration before the World Bank's International Centre for the Settlement of Investment Disputes (ICSID). Other fora for the resolution of Investor-State Disputes include the Arab Investment Court of the League of Arab States, NAFTA, UNCITRAL, and national Courts.

Esquire ILA possesses a wealth of experience in Investor-State Dispute, and its lawyers have regularly been entrusted to represent foreign investors in claims against host states before ICSID, the Arab Investment Court, and United States Federal Courts. A non-exhaustive list of our lawyer's Investor-State Disputes experience includes:

* Representing American and Bahaman investors, as plaintiffs' lead counsel, in a multibillion dollar litigation before United States Federal Courts against the Arab Republic of Egypt and the National Bank of Egypt in connection with various public international law and United States federal law violations committed by the defendants against the clients' investments in a real estate, manufacturing, and media conglomerate in Egypt.

* Representing an American investor, as claimant's lead counsel, at ICSID annulment proceedings against the Arab Republic of Egypt in connection with Egypt's expropriation and destruction of the client's investment in a 182 acre beach front resort in Ain Sokhna, Egypt.

* Representing Saudi Arabian investors, as claimant's lead counsel, at Arab Investment Court proceedings against the Arab Republic of Egypt arising from the inadequate due process of law afforded by Egypt to the client's' investment in a factory in Egypt.
